Legal structure of your purchase
Gi.Ve Engine is software provided by GI.VE GROUP S.R.L. (registered office Via Carlo Fabani 18/B, 23017 Morbegno SO, Italy; VAT no. (P.IVA) 01088150147; R.E.A. SO-81817; PEC gi.ve@pec.it).
For the sale of the software we rely on Lemon Squeezy LLC as Merchant of Record. This means your purchase experience is governed by two separate contracts:
1. Payment contract — Lemon Squeezy LLC
Lemon Squeezy is the legal seller of the transaction. It handles:
- Payment processing and card authentication
- International tax invoicing (including VAT for EU consumers)
- Refund requests within the statutory periods (14 days for EU consumers)
- Payment disputes and chargebacks
- Payment data security (PCI-DSS compliance)
This part of the relationship is governed by the Lemon Squeezy Buyer Terms.
2. Service contract — GI.VE GROUP S.R.L.
Once payment is completed, the Gi.Ve Engine software service is provided directly by GI.VE GROUP S.R.L. under these Terms of Service, which govern:
- The licence to use the software and the recipes
- The features included in each plan (Starter / Catalogo / All-Access)
- The provision of technical support
- Updates to the catalogue and the software
- Limitations of liability for software malfunctions
- The processing of personal data (see also the Privacy Policy and Per-module processing overview (Italian))
Your consumer rights
If you are an Italian consumer, the rights guaranteed by the Italian Consumer Code (Legislative Decree 206/2005) and by European law (GDPR, Directive 2011/83/EU) remain fully applicable to both contracts, regardless of anything in Lemon Squeezy's specific terms.
To exercise your right of withdrawal (14 days): contact Lemon Squeezy via the link in your purchase receipt. For any questions about the service: engine@givegroup.it.
1. Service provider
The Gi.Ve Engine service is provided by GI.VE GROUP S.R.L., registered office at Via Carlo Fabani 18/B, 23017 Morbegno (SO), Italy, VAT no. / tax code (P.IVA / C.F.) 01088150147, R.E.A. SO-81817, PEC gi.ve@pec.it.
2. Subject matter
Gi.Ve Engine is a software ecosystem that lets you generate personal applications from modular recipes. It includes a free Starter version and paid tiers (Catalogo, All-Access).
3. Starter licence
The Starter version is released under the MIT licence. You are free to use it, modify it and redistribute it within the limits of that licence, keeping the attribution.
4. Catalogo and All-Access subscriptions
The paid tiers are provided on a monthly (Catalogo) or annual (All-Access) basis, with payments handled through Lemon Squeezy. You may withdraw within 14 days of first activation with a full refund.
5. Limitation of liability
The software is provided "as-is". GI.VE GROUP S.R.L. is not liable for data loss, lost profits or indirect damages arising from use of the service, except in cases of wilful misconduct or gross negligence as provided by Italian law.
6. Jurisdiction
Any dispute falls under the exclusive jurisdiction of the Court of Sondrio (Italy), except where mandatory consumer-protection law provides otherwise.
7. Changes
These terms may be updated. Substantial changes will be communicated to subscribers by email with 15 days' notice.
8. Vault-type recipes and third-party data
For recipes that process third-party data (e.g. Vault Clienti (Italian)), you acknowledge and accept that you are the sole data controller under the GDPR and applicable law with respect to the personal data of your clients or other third parties entered into those recipes. GI.VE GROUP S.R.L. provides only a software tool that runs on your device and in no case assumes the role of controller or processor with respect to such data.
You agree to indemnify and hold GI.VE GROUP S.R.L. harmless from any third-party claim arising from use of the software in breach of applicable privacy law.
If you enable features that involve sending data to third-party services (e.g. classification via the Anthropic API using your own API key), those third-party services act as your data processors, not GI.VE GROUP's, and you are responsible for independently governing your relationship with them through a DPA and for recording them in your own record of processing activities.
